This Privacy Policy explains how Nishaad Art (“we”, “our”, “us”) collects, uses, shares, and protects your personal data when you use our website, app, and services. We process personal data in accordance with India's Digital Personal Data Protection Act, 2023 (“DPDP Act”) and other applicable laws. By using our services, you agree to this Policy. It should be read together with our Terms of Service.

1. Who We Are

Nishaad Art is a sole proprietorship firm based in Maharashtra, India, with its registered address at Flat No. 10, Sankalp Apartment, Rameshwar Nagar, Ambad Link Road, Nashik, Maharashtra. For the purpose of the DPDP Act, we act as the Data Fiduciary in respect of the personal data we collect from you.

2. Personal Data We Collect

Depending on how you use our services, we may collect:

Account & contact details — your name, email address, phone / WhatsApp number, and login identifiers (for example, when you sign in with Google).
Profile information — details you add to your artist profile, such as languages, social links, and preferences.
Voice recordings & audio — raw voice samples, cue vocals, reference tracks, and any audio you upload or record for production (including recordings made on the Mobile DAW for remote plans).
Submitted material — lyrics, melodies, notes, and other creative material you send with a request.
Usage & technical data — basic information such as device, browser, and app activity needed to operate and secure the service.

Please do not submit anyone else's personal data unless you are authorised to do so.

3. How We Use Your Data

We use your personal data only for legitimate purposes connected to providing our services, including to:

create and manage your account,
produce, record, mix, master, and deliver your tracks,
process your voice samples and recordings to create your final tracks (and, for remote plans, to set up your voice profile),
communicate with you about your orders and requests,
provide support and respond to your queries,
operate, secure, and improve the platform, and
comply with legal obligations.

4. Consent & Legal Basis

We process your personal data on the basis of your consent and as necessary to provide the services you request. By creating an account, submitting material, or placing an order, you consent to the collection and use of your data as described in this Policy. You may withdraw your consent at any time (see “Your Rights” below); withdrawing consent may mean we can no longer provide some or all of the services.

5. How We Share Your Data

We do not sell your personal data. We may share it only:

with trusted service providers who help us run the platform — for example, hosting, cloud storage, and tools we use to operate and deliver the service,
where required by law, regulation, court order, or a lawful government request, and
to protect our rights, safety, or property, or those of others.

Service providers are permitted to use your data only to perform services for us, and not for their own purposes.

6. Data Storage & International Transfers

Your data is stored using the cloud services we rely on to run the platform, which may store or process data on servers located in India or other countries. Where data is transferred outside India, we take reasonable steps for it to be handled consistently with this Policy and applicable law.

7. Data Retention

We keep your personal data only for as long as needed to provide the services, maintain your account and delivered work, and meet legal or record-keeping requirements (such as the records of your agreement to our Terms). When data is no longer needed, we take reasonable steps to delete or anonymise it.

8. Security

We use reasonable technical and organisational measures to protect your personal data against unauthorised access, loss, or misuse. However, no method of transmission or storage is fully secure, and we cannot guarantee absolute security.

9. Your Rights

Subject to applicable law, including the DPDP Act, you have the right to:

access and request a summary of the personal data we hold about you,
request correction or updating of inaccurate or incomplete data,
request erasure of your data where it is no longer required,
withdraw your consent, and
nominate another person to exercise your rights in the event of your death or incapacity.

To exercise any of these rights, contact our Grievance Officer (below). We may need to verify your identity before acting on a request.

10. Children

Our services are intended for users aged 18 and above. We do not knowingly collect personal data from children without the consent of a parent or legal guardian. If you believe a child has provided us data without such consent, please contact us and we will take appropriate steps.

11. Changes to This Policy

We may update this Privacy Policy from time to time. The updated version will apply once posted on our website or app. Your continued use of the services after an update means you accept the revised Policy.
