Nishaad Art is a music and artist services platform operated by Nishaad Art, a sole proprietorship firm based in Maharashtra, India, having its registered address at Flat No. 10, Sankalp Apartment, Rameshwar Nagar, Ambad Link Road, Nashik, Maharashtra. We provide creative production services, including:
We provide production services only on this application. We do not act on this application as a music publisher, record label, distributor, or licensing authority.
You may use our services only if you are legally able to enter into a binding contract under the Indian Contract Act, 1872, you provide accurate information, and you use the platform in accordance with these Terms.
Our services are intended for users who are 18 years of age or older. If you are below 18, you may use the services only under the supervision and with the consent of a parent or legal guardian who agrees to these Terms on your behalf. We may refuse service to any user at our discretion.
Plans are offered as monthly subscriptions. Payment is collected manually / offline, and a plan is activated by us only after your payment is confirmed. Plan credits (tracks, revisions, and any other credits) reset each month and do not roll over to the next cycle.
Unless we expressly state otherwise in writing: fees are inclusive of applicable taxes (we are not currently registered under GST, so no GST is charged; this will be updated if GST registration becomes applicable); and amounts paid are non-refundable once work on your order has begun. Once a track has been delivered to you, the order is considered complete and is not eligible for refund or cancellation. Unused monthly credits are not refundable or transferable. Nothing in this section limits any right you may have that cannot be waived under the Consumer Protection Act, 2019.
When you submit any song request, lyrics, melody, reference track, audio file, voice sample, text, or other creative material, you confirm that:
You are solely responsible for ensuring that your request does not violate any copyright, trademark, or other third-party rights.
We may provide services related to cover songs, backing tracks, re-arrangements, and other music production work based on your request. However:
If your request relates to a copyrighted song, you are responsible for obtaining any permissions or licenses needed for your intended use — including, where applicable, any statutory cover-version license under the Copyright Act, 1957. We only provide the production work and do not obtain these licenses on your behalf.
If you submit an original song, Nishaad Art may help produce it, arrange it, record it, mix it, or master it. Unless we agree otherwise through the app or order flow:
Some services may use artificial intelligence or automation tools. You understand and agree that:
We deliver files only to the requesting user through private delivery. Unless we clearly state otherwise, we do not publish, stream, or distribute your content on public platforms, and we do not maintain a public karaoke library or downloadable catalogue.
Any delivery timelines we mention (including any lead time before a first request on remote plans) are good-faith estimates, not guarantees, and may vary with revisions, queue, and the completeness of the material you provide.
To provide our services we collect and process personal data such as your name, contact details, and the material you submit — including voice samples and recordings. We process this data in accordance with the Digital Personal Data Protection Act, 2023 and our Privacy Policy (privacy.html).
By using our services you consent to this processing for the purpose of delivering your order and operating your account. We use your voice samples and recordings only to produce and deliver your tracks, and we do not sell your personal data. You may contact us (see the Grievance Officer & Contact section) to exercise your rights in respect of your personal data.
If a rights concern or dispute is raised about a private order, we may review the request, pause processing, refuse the order, cancel the service, or ask for clarification.
You may not request us to create or process content that infringes copyright or other intellectual property rights, violates law, contains unlawful material, or is used for fraudulent or harmful purposes. We may refuse, pause, or cancel any request that we consider risky, unclear, abusive, or legally problematic.
By placing an order, you agree to the following:
I confirm that I have the necessary rights, permissions, or licenses for the material submitted in this request, and I understand that I am responsible for any release, distribution, monetization, or commercial use of the resulting work.
We do not guarantee that any file produced through our services will be accepted, monetized, or approved by YouTube, Spotify, Instagram, or any other platform.
To the maximum extent permitted by law, Nishaad Art will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of our services.
Our total liability for any claim will not exceed the amount paid for the specific service giving rise to the claim. Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law, including the Consumer Protection Act, 2019.
You agree to indemnify and hold harmless Nishaad Art, its owner, staff, and service providers from any claim, loss, or demand arising from:
We are not liable for any delay or failure to perform caused by events beyond our reasonable control, including but not limited to power or internet outages, equipment failure, acts of God, natural disasters, epidemics, government action, or third-party service failures.
These Terms are governed by the laws of India. The courts at Nashik, Maharashtra shall have exclusive jurisdiction over any dispute arising out of or relating to these Terms or our services.
We may update these Terms from time to time. The updated version will apply once posted on our website or app. Your continued use of the services after an update means you accept the revised Terms.
